Why you can lower your rent

The rent brake is a law that currently applies in all federal states except Saarland, Saxony-Anhalt and Schleswig-Holstein. The rent brake is intended to prevent rents from rising excessively in new rental contracts.
Here’s the trick: when you move into an apartment, the rent must not be more than 10 percent above the local comparative rent. If your landlord demands more, you have the right to demand a rent reduction.
However, there is no independent institution that checks the lawfulness of the rent level of each new rental contract and imposes penalties on landlords who violate the rent brake. As a result, many landlords simply disregard the rent brake, exploit the housing shortage in many cities and demand exorbitantly high rents in some cases.

Reducing your rent concerns a very sensitive issue – your home. We know that what counts most at home is peace. That’s why we don’t see lowering your rent as a dispute with your landlord. We focus more on explaining your rights and why you are entitled to them.
We therefore successfully conclude around 80 percent of our cases without a court hearing. It is up to you to decide whether to take a claim to the court against your landlord in the event of a refusal.
Private tenancies are subject to strong legal protection in Germany. Terminations issued on the basis of asserting your own rights are therefore invalid. The same applies to pretextual terminations for personal use or other tactics to circumvent this protection. However, having a right is not necessarily the same as getting a right.
